There comes a time in someone's life when they may be unable to work. In those situations, the individual may need to file for Social Security. In some cases, just because someone has filed for Social Security disability in Pennsylvania, due to being unable to work, does not necessarily mean they will be eligible for their employer's disability benefit plan.
An example of this is a case in which a woman was diagnosed with a condition known as fibromyalgia. The woman was approved for disability benefits through Social Security, but she was denied benefits through the company she worked for. Even though she filed a lawsuit against the company, her case was dismissed because she was deemed fit to resume her normal job duties and could have remained at work.
In some cases, a disability recipient may be qualified under the Americans with Disabilities Act. In this case, the woman was not qualified, even though she was determined to be disabled based on the Social Security guidelines. Each employer is different and may not offer certain accommodations.
When someone is unable to perform certain job functions, they may be able to be covered under Social Security disability in Pennsylvania. However, when an employee is still able to perform their normal job duties, an employer may be reluctant to cover the employee under the company's disability benefit plan. Social Security benefits can help those who have been injured or suffer from some form of an impairment. An individual may apply for benefits by contacting their local Social Security Office or by seeking professional help to ensure that all guidelines are met and all applicable benefits paid.
