The FMLA requires covered employers to provide up to 12 weeks of leave, without pay but with health benefits, to an employee who has given birth to or adopted a child or has developed a medical condition requiring care. It offers the same benefits if the employee's spouse, parent, or child has developed a medical condition requiring care from the employee. Upon return from a family medical leave, an employee is entitled to reinstatement to his or her prior position. Employers who contest an employee's eligibility must follow certain procedures established by federal regulations.
