The WARN Act requires covered employers to provide written notice to employees or employee representatives (i.e., unions) of a pending plant closing or mass layoff. There are various guidelines applying to different conditions, such as plant size, the number of individuals affected, the number of employees who will lose their jobs within a certain time period, etc. However, unless the closing or layoff is a result of a faltering business, which could be further harmed by advance notice, unforeseeable business circumstances, or natural disaster, at least 60-days written notice must be given to employees and their agents.
