Filing a Claim Under the VICP

The National Vaccine Injury Compensation Program is a no-fault alternative to the traditional tort system for resolving vaccine injury claims. As mentioned, instead of filing a vaccine injury lawsuit against manufacturers or doctors, the injured must first file their case in the U.S. Court of Federal Claims in Washington, DC.

The vaccine injury will then be put up against the Vaccine Injury Table. The Secretary of Health and Human Services may rebut a claim by proving that the proposed vaccine injury was caused by “factors unrelated” to the vaccine. If this happens to your case, you will not be compensated for your damages. On the other hand, if you can prove that the criteria in the Vaccine Injury Table does not apply, that your injury was actually caused by a covered vaccine, then you will be compensated.

Under current case law, an individual filing a claim must show by a preponderance of the evidence that the vaccine caused their injury by providing:

  • A medical theory causally connecting the covered vaccine and the injury;
  • A logical sequence of cause and effect showing that the vaccine was the reason for the injury; and
  • A showing of a proximate temporal relationship between vaccine and injury.

Compensation awarded under the VICP is paid from the Vaccine Injury Compensation Trust Fund, which is financed by an excise tax on vaccines.
